There are increasing reports of cases in which the legal costs involved in a personal injury case dwarf the claim. The Association of British Insurers has recently revealed that solicitors are currently charging ?2.4 million per day in fees to settle RTA claims.
Many have pointed to astronomical legal fees as evidence of the so-called ?compensation culture? gripping the United Kingdom. Others however place the blame on ?no win no fee? lawyers who speculate on compensation claims to maximise court costs. Both sides of the fence nevertheless agree on the need to reform our compensation system, which according to some, is currently riddled with disproportionate and excessive legal costs.
Recent changes to the assessment of damages and forthcoming reform of costs and funding following the Jackson review are set to transform the legal landscape in relation to personal injury claims. Many fear that such changes will be at the expense of the claimant, restricting access to justice for many injured individuals.
